Court Battle: Poker a game of luck?

Reported by the BBC it looks like a jury in england will decide if poker is a game of luck or a game of skill. This stems from a legal argument of club owner Derek Kelly who is being charged with running an unlicensed poker game at his private members club. His argument is that poker is a game of skill and that he does not need a license to run a private poker game and therefore he thinks the charges should be dropped. This is a constant battle as many states in the US have different interpretations of whether poker is a game of skill or luck. It is an age old question that will constantly be argued over as there are elements of both.
